real estate in probate

my ex-husband and I owned a home jointly that I paid to be built during our marriage. He has an adult daughter from a previous relationship and we have two minor children together. He recently passed away without a will. What is the disposition on our home. His daughter and family moved in the day after his death.

If you owned the house as joint tenants with right of survivorship then upon his death you would become the sole owner of the real estate.
