Dismissal

I am being billed by an individual for some work which he did for me. I have paid him partially but will not pay the remaining amount until he provides me with the paperwork proving he completed the job. There has been correspondence between the attorneys of both parties. My attorney has asked for a signed contract and statement of explanation of what the billing is for, with no response. The judge has asked for a dismissal in the case. At the dismissal hearing does the plaintiff (the man angry I won't pay) have to be present in order for the judge to override the dismissal? If he does not show up is the case automatically dismissed? Can evidence be presented at a dismissal? Is a discussion allowed? Can I ask the plaintiff for the documents? Do I, the defendant, have to have an attorney present?
