Legal Question in Technology Law in Utah

Site Server Linking

Hi, I purchased (actually, am renting) a site through a company about a week ago and they claim that they have not gotten around to linking my site to my server yet because they have others in front of mine. Although, before I paid the $499.00, they promised to link my site as soon as I paid the money. As I've stated, almost a week has past and my site is just sitting there connected to another site, whereas they can collect money. I believe they have visited my site and taken off signs which I have posted to my order forms (momentarily out of service) so that the order would go to this other site. What can I do to get them to work on my site faster, because they know that my site's ordering information is connected to another site and I feel it is unfair for them to remove my messages because they own the site. I know it only takes a few moments to link a site to a server. Any assistance would be greatly appreciated. Thank you

Re: Site Server Linking

Hopefully you have a written agreement which sets forth the terms in writing. If so, carefully read the agreement so that you know what your rights are. If the agreement is oral, you have a problem, because it is not likely that there are any witnesses which could confirm your understanding.

Your options are to threaten to contact the Attorney General's Consumer Fraud Division of the state in which they operate. However this will take some time. You can also threaten to report them to the Better Business Bureau - same problem. Your best bet is to contact their senior management and get written assurances that they will perform in a timely manner. You can also demand your money back. And finally your last recourse is to sue demanding your money back plus all of your losses due to their negligence.
