Legal Question in Credit and Debt Law in Utah

Credit union keeps telling the credit agencies my account was active in the last 3 years. I tell the credit companies I havent had an account or ANY activity since 2000. WELL beyond the 7 year + 6 month reporting times. But the credit union, which is in another state, keeps lying and false reporting. I have written to the credit union and the reporting agencies. Nothing changes.

Can I sue in small claims court in my state?

Can I sue in Federal Court myself?

What is the best practice/course of action for a credit violation once the letters do not work?

You have probably had your identity hijacked, and that is why the out of state credit union reports. Contact that credit union to see whether you can resolve this issue. You can also file a statement with each credit bureau denying that credit report.

If you sue somewhere you will have to prove that you are not the person who used your identity and seek a restraining order to prevent publishing the false information. You cannot use a small claims court. You could file in Federal court, and can do it your self - but you will need to become familiar with the Federal Rules of Civil Procedure.
