You should never, ever waive your Fifth Amendment right not to give a statement that could be used against you without at the very least speaking with an attorney. My motto is "don't talk to cops" as a way just to keep it simple. There may come a day and time when you will give a statement, but the reason that you should not waive your rights just yet, or maybe even ever, is that you have some incredible leverage that can help you get yourself out of a stupid mistake, or maybe a misconstrued accident.

In your case, it may be that they are working off of some grainy video and would have a difficult time actually identifying that its you in a video. Or maybe they are working off of an eyewitness statement that could be shaky. When you make an admission, it is solid evidence against you. So let an attorney leverage that admission into a better plea deal, or possibly even an acquittal at trial if the prosecutor cannot get their evidence or witnesses to trial.

Most attorneys, including our firm, offer free case evaluations, and can look at your case and give you specific, solid advice about how best to navigate any criminal charges.
