Legal Question in Criminal Law in Utah

Utah extradition laws

I was convicted of dui in Utah. The judge sentenced me to one year in Purgatory Correctional Facitity and $2,500 fine. The judge suspended sentence and placed me on bench probation for 2 years.

Terms:

1. Violate no laws.

2. Complete 16-hr dui class.

3. Serve 10 days in Purgatory.

4. Alcohol evaluation.

5. $1,500 fine.

6. 50 hrs. community service.

I live in Arizona now. I cant comply w/10 days of jail in Utah.

Will Utah extradite me?

Re: Utah extradition laws

Maybe. Sounds like its a misdemeanor. Extradition is rare on such a case. However, a warrant would be outstanding and could result in your arrest and detention until such time as an extradition decision was confirmed by Utah law enforcement. If the arrest occurred in Utah, that would create a greater problem.

What may be possible is to petition the UT court to allow you to serve the 10 days here in AZ. Call me directly if you would like to follow up on this possibility.
