Legal Question in Family Law in Utah

Filing a divorce before child is born

After a three month marriage, my soon to be ex-wife has filed for divorce. She is expecting. I assume that a divorce cannot occur before the child is born, especially if we do not agree on the terms or conditions of the divorce. In a case such as this, when does the state imposed 90 day waiting period begin when there are no children involved?

Re: Filing a divorce before child is born

The divorce can occur at any time, regardless of the date of the birth of the child. The waiting period begins on the day the judge signs the divorce decree, although often the waiting period is waived.
