Legal Question in Family Law in Utah

i want to marry this girl who has a kid but is going through a custody battle. I have a job that takes me out of state for 4 months out of the year. If she gets full custody but her ex has visitation can we leave the state for that period of time with no problems?

She may take the child from the state, but must give notice to the ex - unless there is a court order preventing it. She should also file a motion with the court to get permission from the court - just good practice.

If she is awarded primary physical custody, she may leave the state, but is required to proved proper notice under the applicable statute.
