Taking fathers rights away

I was wondering if it is possible to take my ex-boyfriend's rights away regaurding our son. He is three years old and his dad has never played a big role in his life. My son's dad is a big time crystal meth user and He can not keep a job longer than a couple months (if that), very rarely do I get child support. He never visits my son, he has gone 8 months without seeing him in the past and he acts like that doesnt bother him. My son is also allergic to the smell of smoke, it gives him horrible ear infections and he cant breathe very well, even if the person is not smoking around him just being in a house that people have smoked in makes him sick. My son's dad knows this, yet everytime he actually sees my son he smells like he lives in a bar, he doesnt care that it hurts my son. I do my best to be a good mom. I am 24 and I work part time at Radio Shack. I go to work at 9am and i usually get off at 1:30 or 2. Then on Thursday nights I go to Weber State University and I take an on-line class during the rest of the week. I take night and on-line classes so I can be with my son more. I love him more than anything in the world and it would kill me if a judge granted my ex with visitation, which is why I need your help. Thanks

If a parent fails to support; and if a parent has not had contact for six months or more, that parent's rights can be terminated. It is considered abandonment. You also have a duty to protect your child. Do not allow the child to be in conditions where the child will get ill. If no parent determination has beem made, you can require the person who purports to be the father to file a suit to determine paternity. You can contact Utah Legal Services for assistance for low income people.
