Legal Question in Medical Leave in Utah

Family Medical Leave Act (FMLA)
The end of Sep (2008), I am travelling out of state, away from my job to, care for my Grandmother -- as she has terminal cancer with 6-12 months left to live. None of her children can care for her, and she is disabled from the progress of the cancer, so she has to be cared for. Can I qualify for the FMLA or do I have to lose my job because I am biologically her Grandchild and not her child?

Assuming that you and your employer are otherwise covered by and you are eligible for the benefits of the FMLA, the relevant provision reads:

"To care for the employee's spouse, son, daughter, or parent with a serious health condition...."

Nevertheless, check with your employer as they may be willing to give you time off anyway, even though not required by FMLA.
