Legal Question in Civil Litigation in Utah

Small Claims Fees and Attorneys Fees

I recently had a return check turned over to an attorney. I mailed the money order to the company at 5:15 pm after work one evening. Then about 6:30 pm we were served a summons. Would it be worth fighting in court. The attorney wants $2,000 fees. The returned check was 60.81. Should we pay or fight in court?

Unethical Conduct

You really need to invest in your own attorney. My state allows the holder of a returned check to collect a fee of three times the face amount, plus a reasonable attorney fee. Two thousasnd dollars for a lellet is unreasonable and should be reported to the State regulatory agency for attorneys.
