Legal Question in Employment Law in Utah

1099 vs W2 employee
If a person receives primary income from a company under 1099 status and is able able to come and go without permission but completes a majority of the contracted work at the employers office with the employers resources (computers, software) etc. is this person still 1099 or has the line to W2 been crossed?
