Legal Question in Employment Law in Utah

back pay

my employer paid me full pay while I was out having surgeries. I was later approved for a leave of absence. They say that I should not have been paid during this time. I have since left the company and they are seeking the funds back. Do I owe them the money. What are my legal rights. If I do owe, can I set up a payment plan?

Re: back pay

Your rights depend on your agreement with the employer. If your agreement or the published policies and procedures are that employees are not paid under your circumstances, then they may sue to get judgment against you. You will have to defend the lawsuit. Whether or not payments are acceptable is up to the company.
