Legal Question in Employment Law in Utah

Promotion not wanted

The company my wife works for wants to promote her to a more stressful enviroment, and she does not want it she likes her job where she is at. She was given the option of accepting the position or quit. No other option was offered. She doesn't want to quit, but she doesn't want this other position. What are her rights?

Re: Promotion not wanted

She has limited rights unless she has an employment contract. She cannot be forced to accept another position, neither can she be forced to quit. I suggest that if she does not want the new position that she respectfully decline. If they fire her, she may be entitled to some rewards for being terminated without cause (without good reason.)

If she has been at the job for a while she may be able to have additional protections, depending on the size of the company, her position, and other factors.

If she wants to talk about it, have her call me at 801-876-4422
