Legal Question in Legal Ethics in Utah

Family Dispute

My uncle came and purchased me and my brother vehicles. He also housed us on a Campus dorm room. Me and my brother vacated the dorm rooms and are now trying to receive the rest of the money from the school housing since he payed for it the whole year. My question is can he threaten my mom by saying he will take the money out of her income tax so that he gets the money back. In all the things he did he said it was a gift and that we need not to anything in return.

Re: Family Dispute

#1 Based on your grammar, I suspect that college would be a good investment for you.

#2 If your uncle paid for the dorms and you are not using them, you have a moral obligation to return the money to him.

#3 You have no legal entitlement to the money from the college since you did not pay it to the college. Your uncle has legal entitlement to the money.

#4 Uncle cannot take the money from your mother without a court judgment. If he files a lawsuit, he should sue you and your brother.

#5 If there was any gift, I suspect it was subject to you and your brother occupying the rooms and going to school. Once you leave early, the gift is void.
