Legal Question in Medical Malpractice in Utah

I want to be as brief as possible but the incident is in a course of three days.On December 23,2009 being 31 weeks pregnant I started having pain so my doctor told me to get to labor and delivery as soon as I could. Resulting in me coming home about an hour later and was sent home being told it was "Round Ligament Pain" I was then put on bedrest.I was told if I had any bleeding to come back. Later that night I started bleeding. My husband took me to the Brigham City hospital again where I was monitored for a few hours.I was indeed having contractions that were about two minutes apart. They do not have the necessary things to deliver a premature baby so they had an ambulance take me to Mckaydee Hospital. My doctor had requested that I get an ultrasound to check my placenta and everything.I got to Mckaydee around 3:00am. I didn't get my ultrasound until around 4:00-5:00pm.Before then, I was only checked on maybe twice by nurses. I requested to talk to my doctor at the Ogden Hospital plenty of times. The nurses called him,but for about half of the day he was nowhere to be found. Wouldn't answer calls or anything. I was having contractions still about every 4-6 minutes. The nurse came in around 8:00pm and said she was releasing me. I told her I was still having really hard and bad contractions. So she sent me home with Loratab for the pain and some other pills to stop my contractions. The drive home was horrible. I got into the shower and starting throwing up from the medicine they gave me. I then had my husband take me to the hospital. Being told we could NOT go to Brigham, my husband felt he should stop to get some medication for the ride to Ogden. The nurses asked for a pee sample and I realized I was gushing blood. My husband found me in the bathroom where I was passing out time and time again. My doctor had no idea they even sent me home. He came as soon as he could and checked me. I was 8cm dilated. I had to have an emergency C-section due to my daughter being breech. She then was lifeflighted to Mckaydee and spent one month in the NICU.My doctor in Brigham told me if my husband tried to drive me to Ogden my husband would of lost me and our daughter. My future pregnancy's are going to be High Risk now. Our daughter is three months old and is still under seven pounds. She will always be behind in her developmental milestones. I now am on depression pills due to all the emotions of knowing my daughter could of lost her life, due to the carelessness of the nurses/doctors who did NOT attend me while I was there. Also, sending me home without checking me. I owe my life to the nurses/doctors in Brigham city for taking care of me. I adore the NICU nurses who cared for my daughter for an entire month. As for the Labor and Delivery doctors on the night of the 24th. I have NO respect for them. I fear they will do the same to others. Basically my question is, do I have a case?

You may have a case against the doctors and McKay-Dee for their failure to properly diagnose and treat you. Medical malpractice cases are decided based on an evaluation by other qualified medical personnel who determine whether your care was below the normal expected standard of care in the profession. Please call for more information specific to your case. Your consultation is free and no obligation.
