Legal Question in Medical Malpractice in Utah

Neglect to diagnose MRSA

My Grandfather has been treated on and off for UTI's without a culture ever being done in the last 4 months. Now that he is in a state of confusion and close to death, a culture was finally done and shows MRSA in urine. He has been treated for stroke, parkinson's, alzheimers and much more over the last 4 months all because of the neglect to do a simple urine culture. My family members even demanded cultures be done and the doctor still refused for 4 months until last friday. I'm so frustrated and angry. What can I do?

Re: Neglect to diagnose MRSA

Medical malpractice cases are not simple (because of the strong physician lobby). If you believe that there was medical malpractice step one is to get all of the medical records. (2) Have those records reviewed by a medically trained competent person who can ascertain whether the medical staff deviated from the normal standards of care. (3) File a claim with the State Board of Professional Licensing, which holds a simple hearing to determine whether or not it is likely that medical malpractice was committed. (4) If not settled, file suit for the damages.
