I have an offer from the insuance company of the girl that hit me from an accident I got into 11/00. If I settle am I going to have to pay back all the medical bills that I have aquired since the accident? I saw a neurologist, but she can't say for certine that the headaches are related to this accident and this accident only, I got into another one 2/01. Do I have to settle because if I do, they won't offer me enough to pay for the bills. I am no longer with the health insurance company. Any comments would be greatly appreciated. Thank you.

DO NOT settle with the insurance company, unless they are offering you the policy limits. You are entitled to complete reimbursement of your medical expenses. If you are not yet healed or stable, the insurance policy should have a med-pay provision that directly pays your medical expenses (to a limit). In addition, if your damages (loss of work, medical expenses, other related expenses) are greater than $3000 you are entitled to compensation for pain and suffering. Do not believe the insurance company who tells you that they will not pay an attorney who represents you any more than they would pay you. They say these things, and push for an early settlement to avoid paying full costs. Your case is complicated with the second accident. You may call for a free consultation (801) 876-4422
