Legal Question in Real Estate Law in Utah

Process Serving Small Claims Paperwork

I've attempted to process serve my previous tenants and have not been successful in locating them. The post office will not provide their forwarding address and previous attempts to hire a sheriff process server resulted in an undeliverable attempt. Looking for legal advise and potential legal representation for small claim case of $5000 in damages.

Sometimes the post office will give you the forwarding address if you fill out the correct form and offer to pay the modest fee. It used to be only a $1, but it may have changed. There are other ways to handle this matter, and/or locate them.

The post office will no longer provide the forwarding address for $1. For a small fee, a social security # and/or a driver's license # you may be able to locate them through a service on the internet such as peoplefind.com. Keep in mind once you go to court, you are not guaranteed to get your $5,000. If you win, you are awarded a judgment (good for 10 years, then renewable) against them which may or may not be paid in the future. If they are really deadbeats, you may want to write off the loss, use a thorough rental application, and check references on future tenants.
