Legal Question in Tax Law in Utah

Tax Liability after Divorce

When we were married, my X and I filed a joint income tax return. He owned his own business. After the divorce, I found out he had not paid our taxes for several years. I did not work in the business nor did I have any personal income. I have a tax lien against me for half of the taxes owed but have not received any support from him nor did we have many assets to divide. I have no money to pay this. What options do I have?

Re: Tax Liability after Divorce

The IRS will recognize an "innocent spouse" exception and hold you harmless from the tax liability. You may need some help with this, because sometimes the IRS is less than cooperative. You can also petition the court to hold your ex accountable and responsible for the debt and make sure that you are not harmed. If your husband has any assets you can get a judgment against him and collect from his assets or wages. He can also be required to pay your attorney fees. You should talk to an attorney.
