A Father with two sons, and a mother with one daughter both pass away within 3 months of each other, the father passed away first. The Property was soley in the fathers name when he passed away. Through probate the mother was transfering it into her name. With no wills or power of atterney, do all three children inheriate the estate, or just the step sister?

Under Utah law, the mother would receive the first $50,000 of the father's estate, and one-half of the remainder, with the two sons from the father's first marriage receiving the other half of the father's estate. The daughter would receive all of her mother's estate. This scenario would change if any of the children had been adopted by the other spouse.
