Legal Question in Wills and Trusts in Utah

I am named as a beneficiary in my parents will. I am NOT the executor. The executor is attempting to drag out the probate process in order to earn "squatters priveledge" and not honor the will, and, get the house for free. The will says that one of two properties, both owned by the deceased, should be donated to the local Church. My brother wants the house for himself. How to I file to get my inheritance and close the probate process, thereby forcing my brother to actually honor the will? I would like to "honor" my parents wishes and get the house to the Church and not to my greedy, dishonest brother

You need to file a petition to have him removed as personal representative, and place yourself or another individual who will move to administer the estate properly. Even if he is not replaced, the court can give him notice that he has to administer the estate according to the terms of the will, and any attempt to enrich himself can be set aside.
