Legal Question in Wills and Trusts in Utah

My parent's have a living trust. My mother would like to put their car into the trust. They paid cash for the car and my mother has the title. How do we go about putting it into the trust?

I actually often will not put cars in to trust unless they are a very expensive car or a collection type car. There is a small estate affidavit that in Utah will allow the transfer of the car without a probate (as long as the big ticket items are taken care of in trust). If you want it in the trust anyway your mother can sign the back of the title to the trustee of the trust (include the date of the trust agreement) and take it to the DMV and they can help you process the transfer.

The only reason to put a car in the trust is if the car has very high value and she is not likely going to sell the car, but wants to retrain the car for a very long time, or the car is going to be transferred to a family member on her death. You can retitle the car as if you were going to sell the car. However you need to be careful so you do not incur sales costs.
