Legal Question in Business Law in Vermont

I requested 150 gallons of oil be delivered to our home. they delivered 84 gallons more than requested. I called them told them of mistake and asked them to come pump it out. they refused. Am i obligated to pay for this delivery? the 84 gallons?

As a Franchise Attorney I think you need to consider the legal and business aspects here. You can certainly take the position that you don't owe for the excess 84 gallons; you didn't order it and don't want it. The likely result is the oil company will put a freeze on your account until the 84 gallons are paid for. When you've used up all the oil, what will you do? Consult with a good business or franchise attorney in your area for specific advice.
