Legal Question in Military Law in Vermont

OTH discharge, hope of an upgrade or reenlistment

I was discharged in 2000 after 8 months of service under an OTH with 'misconduct due to drug abuse' listed as reason for discharge. I only had a small amount of marijuana and that was in my raincoat in a common area. I did not smoke it and my urinalysis confirms this. I have sent a letter and an appeal over a year ago to see if I can't get my OTH upgraded or granted reenlistment. Is there anything i can do in the meantime to help myself? I am drug free and have never been convicted of drug use.

If you did not exercise your right to an administrative discharge board hearing, when initially being processed, that will hamper your efforts.

There are some things you could do. Feel free to contact me for an additional consultation.
