Legal Question in Family Law in Virginia

If the father of my 2 children has full custody in the state of Virginia but almost 3 years ago he basically said he couldn't afford to take care of them and brought them to live with me in New Mexico, does his child custody order have any validity in the state of New Mexico considering he hasn't seen them in 2 years and owes $40,000+ in back child support???

Yes, until the Virginia order is superceded by a valid order issued

by a court of New Mexico.
