Selling Replica Handbags, Is this trademark Infringement??

Hello,

I just wanted to know, if I sell replica, fake, imposter,

inspired by, handbags and clearly state as such at my

location & on my customers receipts will I be in any

kind of violation of trademark, copyright, or patent

infringement?

Thanks!

Re: Selling Replica Handbags, Is this trademark Infringement??

It depends on what you replicate. If you put someone else's trademark on it, almost certainly. Even though the purchasers would be on notice of the imitation and therefore would not likely be "confused" no such notice would be availble to the general public, who would likely be confused as to the source of the goods.

Your question is probably a little too vague for an attorney to answer. You should probably look for a trademark attorney in your area who can assist you with this question.
