Breach of Contract (Settlement Agreement)

My soon to be ex-husband has breached our settlement agreement. In the agreement I agreed to pay him a monetary amount in exchange for him siging over the house to me and completing the following items. I w/held a certain amount of money in exchange for him completing the following w/in 90 days after he moved (he moved out 3/31/2008): To date he has not removed the remainder of his personal possessions; has not completed the construction of the garage construction & construction thus far is not to code (I just found out); has not removed trash, appliances, old construction materials & debris from yard, garage & mudroom; has not replaced front door (I finally payed an outside contractor to do this); has not removed hot water heater from basement; has not mowed lawn & removed leaves & other debris; has not maintained shed & garage in exchange for their use. All his belongings were supposed to have been removed by June 30, 2008, and garage completed by that date. He refuses to communicate w/me & refuses to remove his belongings. I would like to know if 1) can I get rid of his belongings at this time and 2) can I take the money I w/held to pay a ctr. to complete the construction & remove debris from yard & basement.

I would recommend that you consult with the attorney who (hopefully)is representing you in this matter in regard to your two inquiries and what actions you might now reasonably take under the facts you've recounted.
