Civil Suit

A former has filed a suit on 8 exemployee's over scrap metal.We had permission to take.[from a supervisor] We have a lot of written statements of witnesses.Investagations ended no criminal charges could be filed.Can we as a group counter sue and how? Our Local Union has filed for Aributration afew days ago and we recieved this on (9-17 -07.We were fired in [Jan 2007] They are suing for $80,000.00 I have not been able to even find a job after my unemployment ran out. We are as a Union trying to get our jobs back with back pay. I think they as a company are getting scared.They have accused us of theft & embesselment.Do you think we have a chance or what should we do? All Supervisors pretaining to this case that gave permission have been fired for other reasons so they say according to their security cameras Please Help

If you had proper permission to take your former employer's scrap metal for whatever purposes you chose, then you cannot be convicted of any charge of theft as it relates to the scrap metal.
