Legal Question in Technology Law in Virginia

Copyrighted issue with source code

A business owner approached me to work on their website and verbally agreed to give 30%. He showed lot of potential to the business and after creating a brand new website and doing business and my profit share is around 9k. I also have 30% in the company.

I slowly lost interest and did not add any new functionality as his promises about business were proven wrong. He dumped a developer for me and now he found a new developer and he dumped me.

He now has my dlls but not source code. he emailed me that he is terminating my services and asked me not to login into their servers. He is still running my source code and doing business. He also made some disturbing comments about me and my credibility.

How can I get my source un deployed or how can I get my share of profits.

How do I proceed with it? I gave him 3 options

1. for my 500 hours work at about $100 pay me $50,000. They can own the code.

2. Resolve the partnership and pay me so I would let them use my source code.

3. Undeploy the code if the above options are not satisfactory.

He doesn't reply my emails and he does not want to un deploy. I had to compromise on other offers and family time to build the website.

Please suggest me to get my money back.
