Legal Question in Consumer Law in Virginia

automobile purchase

If I purchase a used car, how long do I have to return it? I have owned the car about 3 weeks. The car has serious problems that existed before I bought it.

Re: automobile purchase

Chances are you purchased the used vehice AS IS, meaning without warranties, and, if so, you cannot now return it, three weeks after the transaction date, unless the seller is willing to take it back and refund your purchase price (not too likely).

However, you could have, nevertheless, a viable cause of action against the seller if he or she made specific fraudulent and material representations regarding the mechanical condition of the vehicle upon which you relied and which consequently induced you to go forward with the purchase of the defective vehicle which you otherwise might not have done had these fraudulent inducements not been made to you on the part of the seller.
