Car Dealer will not return deposit after not disclosing damage to a vehcile pri

I purchased a 1999 Prowler from Dar Cars Chrysler of Fairfax Virginia around 9PM. The next morning I noticed the car had prior accident damage. The dealer never disclosed this information during the sale. I returned the vehicle but the dealer refuses to refund my 2K deposit. I thought that there was a 72hour window on a contract of sale. Or do I have a legal basis for fraud? Any help in this matter would be greatly appreciated

What does the sale contract actually say in regard

to the 72 hour window? However, even if it's silent in this regard, there are still issues

regarding the dealer's responsibility to disclose

to you information as to major defects with the

vehicle prior to completion of the sale.

If the dealer refuses to offer a satisfactory settlement, you should first contact the local

consumer affairs agency for Fairfax County which

may be able to work out a satisfactory settlement. If not, your next stop should

be the Fairfax Co. Small Claims Court where you can file a claim against the dealer for the

return of your 2K deposit for around $30.
