Legal Question in Consumer Law in Virginia

I hired a painter to paint my kitchen cabinets. We verbally agreed on a price, product to be used and handed over a deposit check. Four days in the paint began to peel and we were informed that paint being used was new and not the one we agreed upon. A rep from the manufacturer came out and told us we needed to wait 30 days for curing before any more coats could be applied leaving the job incomplete. We all agreed to reevaluate after the 30 days. Thirty days has just passed and we just received a certified letter from the painter saying we are past due and owe him the balance of our bill that he completed the job. The job hasn't been completed and my cabinets have been left a mess. What are my legal rights/recourse that I can take?

Refuse to pay and demand a refund for what you've already paid him for

a job never completed. Then sue in small claims court for your

damages, if necessary.
