Manufacturer claims Failure to return warranty card voids warranty
The Community Services Board purchased two vans that were modified by the dealer and BRAUN van wheelchair lifts were added to the vehicles. The BRAUN warranty cards were not returned by the group home managers. The lifts have subsequently required repair within the warranty period (3 years/36,000 miles) but BRAUN has stated that failure to return the cards voids the warranty. Please advise.

An attorney would have to look at the exact terms of the contract and warranty. In general, no, there is no such requirement. However, if the contract explicitly says this, then you might not be able to collect on the warranty. But as a general rule there is no requirement to send back some blinking card in order to receive the benefits of a contractual warranty. The question is what the contract actually says.

What did(or do) the warranty cards themselves stipulate as to whether they must actually be sent in to the company in order for the warranty coverage to be effected? In many cases, in order to demonstrate this coverage, all that is necessary is for the buyer to show proof of purchase.
