Legal Question in Credit and Debt Law in Virginia

credit card debt

A collection agency is threatening to take me to court for non-payment of a credit card debt. The credit card was in my name only. My question is this: Can they hold my husband responsible for this debt? We were married when I got the credit card. Can they garnish his wages to collect this debt? They are threatening him as well as me.

Any help is appreciated.

If the credit card was only in your name and was not used to purchase the so-called "necessaries of life" such as food, medical care, or shelter and was not used by your husband to make any purchases, then he is probably safe from garnishment or other enforcement actions by this particular creditor.
