Legal Question in Credit and Debt Law in Virginia

Credit Card

My mother received a Branch Banking & Trust credit card and charged up $16,585.17 trying to pay bills. She is 78 years old & lives in a nursing home long term. I believe that a collection agency is trying to collect on this debt. They are trying to get a judgment against her. Is she obligated to pay this back & am I obligated to pay this back since I am her POA? If there is anything that I need to file on her behalf please let me know.

No, as your mother's POA, you are not responsible for her debts. You could send the collection agency

written notice that your mother is in a nursing home

and incapable of repaying this loan and is now in effect "judgment proof".
