Filing bankruptcy with no income or known assets

I'm a stay-at-home mother in Virginia with no income or known assets. My husband works and attends school and we barely make the rent each month only paying the bills we can. I cannot agree to a monthly payment because I have no money to offer. I have been served a Summons to Answer Interrogatories for an old debt and do not know what to do. Is bankruptcy wise and what does ''willful or malicious'' behavior by a debtor mean?
