Legal Question in Credit and Debt Law in Virginia

Ex husband causing bad credit reporting on me.

My ex husband is not paying the house or car payments on time. My name is still on both because we do not have a property settlement because he won't divide any proceeds equally with me, evan though we were married for 17 years. This has impacted my credit in a negative way. Is there a form or legal document that I can file to force him to sell the house and/or car or refinance one or both into his name only?

All of the matters involving the disposition of marital property which you jointly held with your ex-husband should'be been disposed of in the divorce proceeding(even if there was no property settlement agreement), assuming that your ex had been properly served with papers and was available to appear in the matter. If your former spouse now is not complying with what was ordered in your final decree of divorce with respect to the property issues, then the case should now be reopened for the appropriate enforcement of these orders.

In other words, what you need to do is make sure that the divorce proceedings are complete and address all of this. If you are legally still married, then this is part of being married. Until you are fully divorced, you will have these issues.

What you need to do if he is not following the divorce plan is file for a motion to show cause.
