Can the IRS take my tax check if my ex wife owes money for welfare fraud? She was charged in 2010 with this not me. They didn't take my check while we were married how can they take it now that we're divorced?

Take it for what debt that you supposedly owe? And, no, it can't be for your wife's alleged

welfare fraud; must be something else which only you are responsible for (my opinion).

(As an example, if welfare was paid out to your dependent child(ren) some years back, it's possible that

Virginia's Department of Child Support Enforcement served you with an administrative notice

establishing a debt owed by you for these funds that were paid out to support your family and

then reported this matter to the IRS which is now seizing your tax refund to reimburse the Commonwealth.)
