Legal Question in Credit and Debt Law in Virginia

judgement

I am checking my credit report there is a judgement from a rental property in Virginia for 795 i called to try to settle and the guy got nasty with me and said he could garnish my wages and put a lien on my car. I am wondering since I now live in pennsylvania, can he do this. Thanks

Under Virginia law, which I understand the judgment arises under, the creditor can garnish any wages or property or bank account that may exist in Virginia. However, you said you tried to settle. If you make payment, of course the creditor cannot do anything. It would be highly improper for the creditor to refuse payment simply to garnish your wages. When you say to settle, I assume you were offering less than the full amount.

I don't know (as a Virginia lawyer) what Pennsylvania would do. The creditor would have to take the judgment to Pennsylvania and docket it to make it into a Pennsylvania judgment based on the Virginia judgment. Some States will not recognize a "default" judgment from another State.

In Pennsylvania there is no garneshment of wages. However, the judgment will have to be paid if you attempt to purchase a property and need financing. Suggest you consult with legal counsel. Gerald Hershenson Esq. 215-579-9390
