Wage Garnishment

Can I request the amount of a wage garnishment to be lowered because it would cause a hardship? Thank you.

Re: Wage Garnishment

Wage garnishments are limited to 25 % of the garnishee's net salary; it's unlikely that a judgment creditor would agree to accept less.

Re: Wage Garnishment

If I understand your question, I assume that you are already being garnished every pay period? And you want the amount to be lowered.

You should have received a form with the garnishment to contest the garnishment. You can fill out this form and mail it to the court and to the creditor or creditor's attorney.

You would have to show a valid reason why the amount should be reduced and I have no idea if there are any valid grounds from here.

However, if they are taking too much, or ignoring things like child support, etc., you would have to bring it to the court's attention to get it corrected. So you are entitled t a hearing which would take place within 7 days.
