Legal Question in Criminal Law in Virginia

My 18 year old son was riding with a couple of young people in their vehicle, 1st the girl driving made a few driver errors and was pulled over by the police, the first question asked was has anyone been drinking my son is honest and admitted he had had a beer, and next asked if there was any alcohol in the vehicle, which was searched. Found in the vehicle was a container of a beverage called Loco. It is alcohol. The other passenger said the Loco was his, but yet the police gave both boys a summons for underage possession of alcohol. My son has no priors of any type. He plans on pleading not guilty what should he do?

Your son should get a lawyer to have some chance of successfully contesting

this charge found at Sec. 4.1-305 of the Code of Virginia (Alcohol Beverage & Control Act).
