Legal Question in Criminal Law in Virginia

bad check charges writing them

Can u appeal a sentence if you plead guilty?my daughter has a sentencing coming up real soon. Her attorney is a public defender and in my opinion has not done an adequate job of defending..she is a 1st time offender and has never been in trouble before...there are 4 charges..2 for writing the checks and two for stealing the checks...grand total of 5500.00 Thanks Fred

Re: bad check charges writing them

These are obviously felonies--on all counts---but what efforts were made to get at least two of the four counts dropped in return for your daughter's guilty plea? If no such or inadequate efforts were made, then I would agree with your assessment of the public defender's performance.

And, no, the defendant in entering a plea of guilty, will normally waive his or her right to appeal unless the sentence is somehow illegal or otherwise defective.(very rare).
