insurance fraud

if a person commited insurance fraud almost 2 years ago and the only way the police and company found was bc this person's spouse told on them and turned them in and now is not willing to testify what are the chances of this going away? and if it doesnt go away what would be a sentence for a person with no prior record?

If the spouse of the accused refuses to testify at his or her trial and cannot be compelled to give such testimony due to the spousal-immunity privilege, the case could still be prosecuted and a conviction secured if the prosecutor has other admissible evidence sufficient to convince the trier of fact of the guilt of the accused beyond reasonable doubt.

As to what such a convicted person would receive as a sentence for having been convicted of committing the crime of insurance fraud, there's no way even to speculate about such a sentence without having much more relevant information concerning the crime itself as well as the background of the defendant.
