Legal Question in Criminal Law in Virginia

If a man AGE[21] gets a girl AGE[17] pregnant and she turns 18 after labor can the man be arrested or tried in virginia? Also the virginia age limit between a minor and adult is 3yrs apart; which makes it ok; but what can really be done about this situation?

No adult should be having sexual relations with minor. There are felonies and misdemeanors regarding violation of these of acts. Courts look at the age at the time of the act in most instances.
