Legal Question in Criminal Law in Virginia

Plea Deal

Government offered a plea deal to plead guilty to 3 counts of fenlony larceny and one count of uttering and they will ask not a sentence of no more then 13 months incarceration. No prior record of any sort. There is a possible 8K restitution that the person that brought this matter to the authorities is claiming I stole. I don't think it was that much but at the same time, I am willing to pay whatever dollar amount this person is claiming. Just trying to figure out of there is anything I can say at my preliminary hearing to keep from going to jail. Any input would help. On the flip side, if I don't take the plea, I risk being indicted on 13 counts per the government. All in all, I am trying to see if there is a chance where I could try for a suspended sentence, probation, or any other sort of sentence outside of jail. Thanks for your time and attention.

Re: Plea Deal

Better take the plea and get those other 10 counts dismissed. Your lawyer will still be able

to argue at your sentencing that you should serve your sentence in ways other than by 13 months in the local slammer.
