Legal Question in Criminal Law in Virginia

Possession of weapon on school grounds

I'm a substitute teacher. I also help out with the youth group at my church on wednesdays. During a recent church skit an Indian sword was used. After the skit I left the sword in scabbard in my car. I forgot to remove it from my car. Yesterday I was assigned to teach at a local high school. I parked in a student spot accidentally because the school didn't tell me where to park. A deputy sheriff was called and he looked at my car and saw what he thought was a sword on the floor in the back of the car. The deputy sheriff believed there was no criminal intent, but because the sword was already reported was forced to serve me with a warrant of misdemeanor instead of giving me a warning. In a case like this, will a judge or jury usually have sympathy with the defendant and throw the case out?

Re: Possession of weapon on school grounds

The question is not whether the judge will be sympathetic as this implies that you

will plead guilty and ask for mercy. The issue is whether

you have any defenses to win the case, since you

have already been charged. There are different

scenarios that could occur so I need more info.

Give me a call (no charge) to discuss ther facts.
