Legal Question in Criminal Law in Virginia

Virginia Firearms Code - convicted felon

I am a person who was plead guilty in VA to a non-violent felony 10 yrs ago. My friend who has never been convicted of any crime has asked me to move in with him. He owns his own farm. I know that I can not posses or own a firearm however I know that my boyfriend owns a gun to hunt deer which he keeps locked in a safe. Can I live with him or does he have to get rid of the gun in order for me to live there?

No, your friend should not have to give up his gun(s)under the circumstances described in order for you to avoid being charged as a felon in possession of a firearm. Obviously, however, you should not be holding nor discharging this weapon under any circumstances which could be construed as possessing it in violation of the law.

I agree. You should not be any where near the gun at any time for any reason, as you would then run the risk of being in constructive or actual possession.
