Legal Question in DUI Law in Virginia

Serving of 65% Sentence Law

My 42 year old son is in prison due to several DUI's. He keeps asking for information on a law which provides that a prisoner serve only 65% of his sentence. Is there such a law, and how does it work?

Re: Serving of 65% Sentence Law

I am not aware of any such law. In Virginia,

which abolished parole effective 1/1/95, those inmates who are serving penitentiary sentences,

must serve, roughly, 87 to 88 per cent of the

sentence before they are eligible for release.

(Three or more DUI convictions within a 10 year period in Virginia is a felony which can get you such a sentence.)
