Legal Question in Elder Law in Virginia

conservership of elder

My grandmother has severe

dementia and many medical

problems. I am caring for her full

time at her home. She has large

stock accts. and owns rental property

that could be sold to pay nursing

home bills. I asked my uncle to look

into conservertership so we could get

the money to put her in a nursing

home. He said it would cost over

$75,000 just to go thru the courts

to get conservertorship status!!! Is

this right? I think he just wants me

to keep taking care of her 24/7 in

order to protect his future

inheritance!!! How much would it

really cost to get guardianship? We

have several doctors that could

attest to her dementia and need for

nursing home care.

Thank you,

Re: conservership of elder

Every case has to be based on its own particular facts, but it would be unusual for an uncontested appointment of a conservator to cost anywhere near $75,000.

If there's a big family fight, the attorney's fees can get pretty high.

I suggest you contact an attorney in your jurisdiction through the Virginia Attorney Referral Service, and get an evaluation of the cost in your case.

Good luck.
